These Terms of Service ("Terms") constitute a legally binding agreement between you and John Gault & Sons ("we", "us", or "our") governing your access to and use of https://video.pathwaydevs.org (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property or other rights of any third party; transmit malware, spam, or other harmful or deceptive content; attempt to gain unauthorized access to the Service or its related systems; or interfere with other users' enjoyment of the Service. We reserve the right to suspend or terminate access for any violation of this section.
When you create an account, you must provide accurate and complete information and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@pathwaydevs.org of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
You retain ownership of content you submit, post, or upload to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate the Service. You represent that you own or control all rights to your User Content and that it does not violate these Terms or any third party's rights. We may remove User Content at our discretion.
Membership costs $5.00 (USD), paid through Stripe. The billing terms, including any renewal schedule, are shown at checkout before you pay. Payments are processed by Stripe, Inc. under its own terms. Except as required by law, fees already paid are non-refundable. We may change membership fees upon reasonable advance notice.
You must be at least 18 years old and the age of majority where you live to use the Service. The Service may include mature content. By using the Service, you confirm that you meet these requirements and that viewing such content is lawful where you are located.
Registered users may upload their own videos, along with titles, descriptions, thumbnails, and comments. You keep ownership of what you upload. By uploading, you grant John Gault & Sons a worldwide, non-exclusive, royalty-free license to host, store, transcode, display, distribute, and federate that content as needed to operate the Service. You confirm that you own or have all rights and permissions needed for everything you upload, including the consent of every identifiable person shown.
Content on the Service is lightly restricted, with firm rules. Uploads must be lawful where they are posted and viewed. Prohibited at all times: any sexual content involving minors; sexual content shared without the consent of everyone depicted; content that infringes someone else's copyright or other rights; credible threats, doxxing, or incitement to violence; and malware, spam, or fraud. Mature content must be marked as sensitive using the platform's content settings. We may remove content and suspend or terminate accounts that break these rules, and we report child sexual abuse material to the appropriate authorities.
If you believe content on the Service infringes your copyright, send a notice to support@pathwaydevs.org with: your contact information; identification of the copyrighted work; the URL of the material; a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. Uploaders whose content is removed may send a counter-notice to the same address. We terminate the accounts of repeat infringers in appropriate circumstances. Other takedown requests, including privacy or consent concerns, may also be sent to support@pathwaydevs.org.
We may review, restrict, or remove any content and suspend or terminate any account at our discretion, including to comply with law. You are solely responsible for content you upload and for having all rights needed to share it.
The Service, including its text, graphics, logos, and software, is the property of John Gault & Sons or its licensors and is protected by copyright, trademark, and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOHN GAULT & SONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts located therein, and the parties consent to their exclusive jurisdiction.
We may revise these Terms from time to time; the updated version will be posted on the Service with a revised effective date, and continued use of the Service after changes take effect constitutes acceptance. Questions may be directed to support@pathwaydevs.org.
